Is ISO 45001 a legal requirement?

No, ISO 45001 is not a legal requirement. It’s a voluntary standard that organizations can choose to implement to manage and improve their environmental performance. However, compliance with the standard can help organizations ensure they meet relevant legal and other regulatory requirements related to the environment.

The latest revision of ISO 45001, as of my last update in January 2022, is ISO 45001:2018. Standards are typically reviewed every five years, so it’s a good idea to check with ISO’s official website or relevant bodies for any new updates.

The ISO 45001:2018 standard is structured into several clauses. Grouping them into six main areas, they are:

  • Context of the organization.
  • Leadership and worker participation.
  • Planning.
  • Support.
  • Operation.
  • Performance evaluation and Improvement.

ISO 45001:2018 brought several changes compared to its predecessor, OHSAS 18001. Major changes include:

  • A new structure (aligning with the High-Level Structure used for other ISO standards like ISO 9001 and ISO 14001) making integration easier.
  • A stronger focus on the “context of the organization,” ensuring the OH&S management system is tailored to the organization’s specific circumstances.
  • Greater emphasis on leadership and worker participation.
  • Risk-based thinking embedded throughout the standard.
  • Expanded focus on ensuring that the safety management system is proactive, rather than only reactive.
  • A focus on the supply chain and outsourced activities.

Organizations implement ISO 45001 for various reasons:

If you were previously certified to OHSAS 18001, you would have needed to migrate to ISO 45001 by March 2021, when OHSAS 18001 was officially withdrawn. If you are certified to ISO 45001:2018, your certification’s validity will typically be three years, subject to successful surveillance audits. However, always check with your certification body for the exact validity of your certification.
